Under Ohio law, the Probate Court is the only government agency authorized to issue marriage licenses. Couples who wish to get married must obtain a marriage license by applying through the court. They can download a marriage license application from the court’s website, fill it out, and submit it with statutory fee. Some of the information that is required to process their application are their names, ages, places of birth, occupations, and their parents’ names. They should also identify the person who will solemnize their marriage ceremony. In Stark County, this can be an ordained minister of a religious group, an authorized judge, or the mayor of a municipal corporation.

Not just anyone can get a marriage license, in any case. Applicants should be adults aged 18 years or older and not have closer relations to each other than second cousins. They must also be unmarried. A person who is seventeen (17) years of age, with the consent of the Juvenile Court, may marry a person who is not more than four (4) years older. Application must be made in person, by both parties. People who were previously married must disclose, in their marriage applications, details of their former spouses and the children of that marriage if any. They must also provide a certified copy of a divorce decree if the marriage ended by divorce or a death certificate if the marriage ended because the spouse died.

In Stark County, at least one of the parties to the union must reside in the county for the court to issue a marriage license. However, if both live outside Ohio but perform their marriage in Stark County, the court can issue a marriage license.
